By participating in this Bonus Battery event, you agree to these Terms and Conditions, which will at that time become binding between you and us.

PROMOTER

ELIGIBLE CLAIMANT

The bonus battery offer is only open to claimants who are eligible claimants. An “eligible claimant” is a person who:
a) is either an Australian citizen or an Australian permanent resident (Australian residents);
b) purchases one of the selected kits at a participating Authorised Retail Partner as part of the bonus battery offer.

The bonus battery offer is only open to Australian residents aged 18 years or over who make a purchase for professional trade use only.

Ineligible to register and claim: employees of the Promoter and their immediate families, employees of the Promoter’s related companies and their immediate families and employees of any of the Promoter’s Authorised Retail Partners involved in this bonus battery offer and their immediate families.

BONUS BATTER CRITERA & BONUS BATTERY DETAILS

1. BONUS BATTERY OFFER & BONUS BATTERY PERIOD

Purchases must occur in store at participating Authorised Milwaukee Retail Partners on Thursday 8^th until Friday 9^th September 2022 during trading hours in order to receive the bonus batteries, while stock lasts.

The bonus battery period commences on 7.00am AEST Thursday 8^th September 2022 and closes at 6.00pm AEST (local time) on Friday 9^th September 2022. The bonus battery is a “while stocks lasts” offer and is limited to the first 36 Milwaukee selected Power Pack purchases and subject to the trading hours of participating Authorised Milwaukee Retail Partners.

For clarity, a claimant must purchase any selected Milwaukee M12™ or M18 FUEL™ Power Pack ([AP3] [AS4] M18FPP4L2-503B, M18FPP2A2-502C, M12FPP2A-421B, M18FPP3M2-502B, M18FPP6F2-503B) in store between Thursday 8^th September 2022 and Friday 9^th September 2022 from a participating Authorised Retail Partner and the claimant must receive bonus batteries at the time of purchase. This bonus battery offer is while stocks last and is limited to the first select 36 Milwaukee Power Packs purchases made instore at each participating Authorised Retail Partner.

2. PRODUCT “BONUS BATTERY” OFFER

Claimants can only claim the bonus battery offers in store at a participating Authorised Retail Partner on Thursday 8^th September 2022 or Friday 9^th September 2022 while stock lasts. The bonus battery must be validated by a Milwaukee representative or if not present, by an authorised retail representative of the participating Authorised Milwaukee Retail Partner.

The ”bonus battery” offer is limited to 36 Milwaukee “bonus batteries” per store.

3. VALID APPLICATIONS

A valid proof of purchase requires a store receipt from a participating Authorised Retail Partner over the two-day event (7.00am AEST Thursday 8^th September 2022 until 6.00pm AEST (local time) Friday 9^th September 2022).

5. HOW TO RECEIVE THE OFFER

To be eligible for the bonus battery offer, a claimant must, during the bonus battery period complete the following:

a) You must have purchased the qualifying Milwaukee product (Milwaukee M12 / M18 FUEL™ cordless Power Pack, at the Milwaukee Authorised Retail Partner outlet in Australia between Thursday 8th September 2022 and Friday 9^th September 2022. Online sales are not eligible.

b) Provide proof of purchase receipt to be validated by a Milwaukee representative or if not present, by an authorised retail representative of the participating Authorised Milwaukee Retail Partner.

This offer is limited to the first 36 selected Milwaukee M12 / M18 FUEL™ Power Packs purchased in Participating Authorised Milwaukee Retail Partners between Thursday 8^th September 2022 and Friday 9^th September 2022.

6. DELIVERY

There is no delivery requirement for this offer as bonus batteries are received instantly in store upon successful purchase, while stocks last.

GENERAL

No responsibility will be accepted for late or misdirected claims. A copy of the original receipt as proof of purchase is required. The Promoter may require claimants to provide further information regarding the circumstances of the product purchases to the Promoter or its agent as part of the redemption verification process. Failure to provide this information to the Promoter’s satisfaction may result in an invalid claim at the Promoter’s discretion. Claims may only be submitted instore, and in the correct form provided for in the information on how to redeem a bonus offer and will not be accepted by the Promoter in any other form.

Any misrepresentation or fraudulent information supplied by a claimant disqualifies their claim(s). The products cannot be returned and are not, transferable or exchangeable and cannot be taken as cash. The Promoter reserves the right, at any time, to verify the validity of entries and eligible claimants (including an eligible claimant’s identity and place of residence) and to disqualify any eligible claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the redemption. The Promoter is not responsible for any technical malfunctions or acts in violation of these Terms and Conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person. Any taxes which may be payable as a consequence of a claimant receiving a product are the sole responsibility of the eligible claimant or participant. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties or similar consumer protection laws in the States and Territories of Australia that are incapable of being excluded (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the redemption.
GOVERNING LAWS

The laws of Victoria, Australia apply to this redemption and these Terms and Conditions to the exclusion of any other law. Claimants submit to the exclusive jurisdiction of the courts of Victoria, Australia.
